In order to preserve the
exclusivity, character and environmental sanctity of the
Mineral Springs lands for the enjoyment of all owners
for years to come, a number of protective covenants have
been put in place. They are:
1. No
Dwelling shall be erected on the Lot having a ground
floor area of less than one thousand one hundred (1,100)
square feet and shall have a minimum of one thousand
four hundred (1,400) square feet total floor area. The
expression “Floor Area” shall mean the total habitable
floor area within a building measured between the
exterior faces of the exterior walls, excluding any
garage, breezeway, porch, veranda, balcony, sunroom,
attic, basement, cellar and any floor area with a
ceiling height less than six and one half (6.5) feet.
2.
No Dwelling shall be erected on the Lands without a
fully enclosed garage large enough to accommodate at
least one automobile.
3.
No signs, billboards, notices or other advertising or
promotional matter of any kind (except the ordinary and
usual signs offering the Lands or buildings thereon for
sale or rent) shall be placed on any part of the Lands.
4.
No excavation of soil or rock shall be made on the Lands
except excavations for the purpose of building a
dwelling, septic system or driveway. No material
removed from any part of the Lands shall be placed on
any adjoining Lots or any property belonging to the
Seller and further, no material shall be placed on any
part of the Lands so as to interfere with the drainage
of surface water.
5. No
part of any building shall be placed closer than sixty
(60) feet from the front Lot line or closer than forty
(40) feet from a side Lot line of any Lot, except to the
extent made necessary by the topography or other natural
features of the Lot, provided that the set back
requirements of the applicable zoning by-law shall be
complied with in any event (the “Building Envelope”).
6. No
living tree located closer than sixty (60) feet from the
front Lot line or closer than forty (40) feet from a
side Lot line of any Lot having a trunk diameter of four
(4) inches or greater when measured at the point on the
trunk that is twelve (12) inches from the ground shall
be cut down or removed from the Lands other than a tree
standing within four (4) feet of any area to be
excavated or cleared for the construction of a septic
system, driveway or overhead hydro or telephone line.
7. Notwithstanding
paragraph 6 above, the total cleared area of any Lot
shall not exceed twenty five percent (25%) of the total
land area of the Lot.
8. No
building shall be erected on the Lands having external
walls of any material other than wood, stone, brick,
log, stucco, vinyl or any combination thereof, and no
colour other than a muted and an environmentally
complimentary, compatible colour shall be used in any
exterior wall, window finish, door finish, or roofing
material.
